Jami` at-Tirmidhi: Book 14, Hadith 54
This Hadith is Hasan Sahih.
We do now know of it being Marfu’ except by the narration of ‘Amir Ash-Sha’bi from Abu Hurairah. Others have reported this Hadith from Al-A’mash, from Abu Salih, from Abu Hurairah in Mawquf form.
This is acted upon according to some of the people of knowledge, and it is the view of Ahmad and Ishaq.
Some of the people of knowledge said that one may not benefit in any way from what is pawned.
“ الظَّهْرُ يُرْكَبُ إِذَا كَانَ مَرْهُونًا وَلَبَنُ الدَّرِّ يُشْرَبُ إِذَا كَانَ مَرْهُونًا وَعَلَى الَّذِي يَرْكَبُ وَيَشْرَبُ نَفَقَتُهُ ” . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ لاَ نَعْرِفُهُ مَرْفُوعًا إِلاَّ مِنْ حَدِيثِ عَامِرٍ الشَّعْبِيِّ عَنْ أَبِي هُرَيْرَةَ . وَقَدْ رَوَى غَيْرُ وَاحِدٍ هَذَا الْحَدِيثَ عَنِ الأَعْمَشِ عَنْ أَبِي صَالِحٍ عَنْ أَبِي هُرَيْرَةَ مَوْقُوفًا . وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ . وَقَالَ بَعْضُ أَهْلِ الْعِلْمِ لَيْسَ لَهُ أَنْ يَنْتَفِعَ مِنَ الرَّهْنِ بِشَيْءٍ .

The above hadith is from the Jami` at-Tirmidhi collection of hadiths. As a cornerstone of Sunni hadith literature, the Jami` at-Tirmidhi was authored by Imam al-Tirmidhi in the 9th century.
